Una justificación y dos objetivos de la distribución de beneficios de la biodiversidad marina fuera de jurisdicciones nacionales (a justification and two objetives for benefit- sharing of marine biodiversity beyond national jurisdictions)

Resumen


La nueva regulación del uso de la biodiversidad marina ubicada fuera de jurisdicciones nacionales incluirá la distribución de sus beneficios. Sin embargo, no hay acuerdo sobre una justificación para distribuir y hay objetivos referidos solo a equiparar técnicamente usuarios. Este trabajo cuestiona la inexistencia de justificación y objetivos de la distribución como compartir valor, desde la especialidad y la integración. Para esto, planteamos que la utilización equitativa y eficiente de la Convemar justifica compartir valor conforme su contenido económico, mostrándose como principio. Luego sugerimos dos objetivos, previa integración de normas transversales y análogas. De las primeras, señalamos que la inclusión del Desarrollo Sostenible permite utilizar a la superación la pobreza como objetivo de distribución, mientras que las operaciones de reparto espacial, cursos de agua internacional, plataforma continental y límites marinos muestran criterios socioeconómicos de distribución sin límites a priori, indicando un estándar de distribución más intenso, relativo a la promoción de igualdad material
